Kooij Limited Warranty and Repair Policy The Kooij Products produced by Kooij and sold by Kooij, an authorised dealer or reseller are covered by the limited warranty as decribed and subject to the terms and conditions below during 5 years (“Warranty Period”) as off the purchase date of the original and new Kooij Product. Kooij products are made from recycled plastic and the highest quality illumination and assembly fixtures. Plastic components are tested regularly for defects or impurities. Despite the best efforts of Kooij, recycled plastic can occasionally develop surprising characteristics after many years of use. Unacceptable characteristics may include cracking or delamination. Should the customer observe a defect of any nature under normal use conditions, they are encouraged to contact their point of purchase to initiate a warranty or repair process. As a self-producing studio, Kooij endeavours to provide service wherever reasonably actionable, considered on a case-by-case basis.
Only the customer who originally purchased a new Product from Kooij or any of its authorized dealers or retailers may make claims under the limited warranty. The limited warranty does not extend to any subsequent buyer or other transferee of a Product. In order to submit a claim or request for repair the customer is required to present the original invoice of purchase of the Kooij Product and provide individual information. If, within the applicable Warranty Period, any product proves to be defective, Kooij will, at its own discretion, either repair, have repairedor replace the affected product or part at no charge. Kooij is entitled to replace the affected product with a product of similar value to the original purchase price of the affected product. Instead of repair or replacement, Kooij has the right, at its sole discretion, to grant a refund or price reduction for the affected product, which is calculated based on the sales price of the product at the time of purchase. If Kooij is of the opinion that a replacement of the Kooij product is necessary it will contact the customer to provide instructions for shipping the defective product, the costs of which will be borne by Kooij in such case. Replaced products or replaced product parts shall become the property of Kooij. Delivery of a replacement product or repair of a product does not result in a renewal or extension of the applicable warranty period. Kooij’s total liability is in any case limited to compensation of the amount of the invoice with regard to the relevant Kooij product. Should the product prove defective after the Warranty Period the limited warranty does not apply anymore. However, the customer is still welcome to raise the issue with their point of purchase, in order to assist the customer in having the Kooij Product repaired by a third party on its own account and costs. The remedies under this limited warranty are sole and exclusive remedies and Kooij’s entire liability for any breach of this limited warranty. This warranty and repair policy and all claims, rights, obligations, offers, orders and agreements arising from it are governed by Dutch law only. Any disputes between parties will be submitted to the jurisdiction of the competent Courts in the Netherlands. |
